Binding Financial Agreements can be entered into before, during or after a relationship (both a marriage or a de facto relationship) but there are complex legal requirements to ensure their longevity and enforceability.  These requirements stem from the terms of the Family Law Act 1975 (Cth) and the case authority from decisions in both the Federal Circuit Court of Australia, Family Court of Australia and the High Court of Australia.
