Luke is part of Marino Law’s commercial and business, property, and franchising law team.
His days involve providing advice on a wide variety of commercial issues that arise in operating small to medium businesses, where he assists clients who are growing their business or wanting to protect what they’ve established. This includes setting up and structuring businesses through shareholders agreements and trusts, registration of trademarks, the protection/licensing of intellectual property, drafting bespoke commercial agreements (such as terms and conditions of trade, supply agreements and distribution agreements), and acting on sale and purchase transactions for businesses, company shares and rent-rolls.
When it comes to property law, Luke has extensive experience in retail and commercial leasing through acting for both landlords and tenants in drafting, reviewing, negotiating new leases, renewals and assignments. He has also managed the conveyancing transactions for many commercial properties.
With a particular speciality in franchising law since commencing legal practice in 2013, Luke has acted for a diverse range of multinational franchisors and franchisees. His experience in acting for franchisors includes advising on day-to-day operational issues and regulatory compliance, drafting/updating franchise agreements and disclosure documents, and acting on new grants/renewals/resales. From the setting up of new franchise systems to working closely with established franchisors, Luke assists his clients to maintain that careful balance of a healthy franchisor/franchisee relationship.
Luke has also helped franchisees of many different franchise systems achieve that exciting goal of becoming business owners. After giving advice to determine the best business structure, Luke carries out a comprehensive review of the franchise agreement, gives plain-English advice on the key terms and considerations, and then negotiates any necessary changes.
In his spare time, Luke is an active member of the Queensland Law Society Franchising Law Committee. This allows him to keep on the forefront of the latest developments in laws and cases affecting franchising, and to contribute towards submissions to the government on topical issues facing the franchising industry.
