Investor & Business Visas

Marino Law prides itself on its business migration services, complementing the firm’s commercial, corporate and property law divisions. If you want to establish or develop a business in Australia or make an investment in an Australian state or territory, there are certain visas which may be available to you which allow you to live in Australia on a temporary or permanent basis, provided that you manage a business in Australia or maintain a complying investment.

The types and amounts of investments vary considerably based on the stream of visa being applied for and range from $500,000 to $15 million.

Business and investment migration visas are inherently complicated. You must be nominated or sponsored by an Australian State or Territory and pass a points test in order to be eligible under the Department’s Business Innovation and Investment Visa Program and the requirements for nomination or sponsorship vary from government to government as well as for each stream of the visa. In light of the complexities and/or the levels of investments that are required for a business innovation and investment visa, we strongly recommend that you seek legal advice in respect of your application.

In order to obtain permanent residency, typically you must first hold a provisional visa in order to qualify for a permanent residency visa on the basis of your business or investment ability. You may however be eligible for a permanent Business Talent (subclass 132) visa or, depending on your circumstances, the Investor Retirement visa (subclass 405), a temporary visa which may be suitable as it allows you to make a significantly lesser investment compared to the other types of investor visas.
